Notice of Hearing To The Tenant Or The Occupier (Public Helpdesk Query)

Mr David Franks

27 January 2010

Our tenant has received this notice with regard to a property we let fully managed. The landlord has informed us that he is in arrears with Mortgage Express, but has been paying towards the loan each month, and in April will come off his fixed rate to a much lower where the rental from the property will cover the loan and be able to start repaying arrers.
What my question is? The Court case is 5th March 2010 if the case is in favour of the lender will our tenant only have 14days to vacate.
We do have a 12 month AST which Commenced on the 30 October 2009 or once a noticed is served will it be for the full 2 month notice.
The Tenants wants to stay if possible, the landlords needs them to stay to help with expenses.
Regards
David Franks
