Offer to pay arrears (Public Helpdesk Query)

Graham646464

7 February 2010

We have served a section 8 for two months arrears. This notice matures on 16th Feb.

We have had an offer to pay 4 equal weekly instalments to clear the arrears. If we accept this offer and only one payment is made, the arrears will cease to be 2 months. Would this mean that the section 8 was no longer valid and would we then have to wait until the next monthly payment would be in arrears? Could we use section 10 persistent arrears? There is a history of broken payment promises.

Please give what advice you can.

Thank you
