Makeover for possession rules - April / May 2001
New and faster possession procedures are to apply from October.
The newly published Civil Procedure (Amendment) Rules 2001 say that possession claims must be heard usually ('the standard period') within eight weeks of a claim being issued.
Defendants must be served with claim forms and particulars not less than 21 days before the hearing date and, in the case of accelerated possession claims of property let on an assured shorthold tenancy, any defence must be filed within 14 days of receipt of notice.
Defendants who do not files defences within the specified time will still be able to take part in hearings although the court may take this into account 'when deciding what order to make about costs'.
