My tenant just informed me by email that he has moved out 6 days ago, which means he didn't give me one month notice as required in the AST. He also indicated that he can drop the keys to me anytime, but he won't be able to pay the previous rent arrear and asked to deduct it from the deposit. But the deposit can only cover one month arrear, while the total arrear (including the last one month without notice) is more than what the deposit can cover. I haven't mentioned the damages and rubbish he left behind.

My questions are:

As he indicated that he have moved out, can I just enter the property legally with my own keys? If I do enter with my own keys, will I lose my right to ask for the rent of the month he owes me the notice?

Any advice please? Thank you.
