I believe the ico is wrong but appreciate that current guidance says the agent can only share refs if the prospective tenant and referee both agree in advance. So letting agency or ref company could obtain this consent when tenant fills in form and also when obtaining eg employer and landlord refs. Rent4sure have a big red notice telling agents they can't pass on refs. This is an issue as I want to know why my p t is a medium credit score and make the decision myself. I don't just want Rent4sure saying "acceptable".
1 Is there a ref agency that has procedures which allow refs to be passed on?
2 If I get the ref myself eg through the RLA recommended agency I will get the information but have to do more work while my letting agent does less. Would I then have to register with the data protection people?
I'm planning to use the RLA tenancy agreement and privacy notice.
