You say that this should be effective "so long as the tenancy agreement is properly drawn up to make this clear. Clear dates and amounts payable are required. The agreement must state that payments are made in respect of rent and not by way of security for rent." Could you give an example of the precise wording necessary. Also how would the Tenancy agreement convey that if the tenant gives one months notice, he would be entitled to a refund of the second months rent in advance (provided that the flat was left in good condition,keys returned etc - in fact all the usual conditions for the return of a deposit).
