We have just bought some flats which are in need of full refurbishment works but have tenants in them. most of the tenants are 3+ months in arrears. these flats were let on a 'as seen' basis and any remedial works were pointed out to the tenants and accepted, but we have nothing in writing from the tenant confirming that they were happy to take the flats in their current condition. if we try to go for a section 8, would the court throw it out on the basis that works are required if the tenants mentions it? as the new owners, we will be refurbing every flat in the next 12 months but need to do something about the arrears situation.
