I gave my tenant notice on 1st Oct by letter. He has taken this to the local council Housing Options together with his Tenancy agreement and Notice requiring Possession which I gave him not long after he moved in.

They have refused to deal with his application because

they say it's not legal (should have had Housing act etc on the top
Must be from the date the tenancy started ie 5th May (2009) so therefore 5th Oct to 4th Dec which I have now missed so they say it has to start on 5th Nov.

Also advised him not to move out but to wait until I go through the court action for eviction + wait for bailiffs!

Any advice please
