We have lodged a claims process with the DPS as the tenant left the property in a damaged state and is now disputing this, and they have given them more time as they did not fill in the form correctly. I have been told that if they don't agree to use the adjudication service then there is nothing they can do - they will just hold the money until the tenant agrees.

We have had to pay for repairs before we could relet. How is this fair as it seems tenants can cause damage and get away with it - is there any way we will get out deposit back?

Taking a deposit seems useless if you can't get it back once damage has been done?

Can anyone advise?
