We have a prospective landlord who granted an ast on 28/01/08 via an agent.

The said agent has been closed down by oft sometime in 2009.

The authorised tenants sub let the property and have vacated the property themselves. The property was sublet to 3 different couple, 2 of whom have one child each.

Initially the landlord did not know what to do; the landlord approached us for help at the beginning of 2012.

We advised him to protect the original tenantís deposit and serve them with appropriate prescribed information; leaflet and deposit protection certificate regardless if the tenants have vacated the property.

The landlord has now again approached us to evict the subtenants.

He has created tenancy between himself and the subtenants by accepting rent directly from the sub tenants.

The property is L.B. of Newham and the landlord has been requested to apply for a mandatory HMO licence has the building is 3 storyís and is occupied by more than 5 persons.

Please advise if the following is the correct way of going about gaining vacant possession of the property.

1. Serve the original, sub tenants and the occupiers with Section 47 & 48 of L&T Act 1987.

2. Serve the original, sub tenants and the occupiers with periodic section 21 notices

3. On the expiry of the notice submit N5 with N119 and request possession on hearing.
