I have a AST with fixed term (6 months)came to an end 6th March 2010. The tenants were paying rent every 4 weeks which has been changed to a monthly rent at their request, rent being due 1st of every month.

To get rid of the tenants who are over two months behind with rent, do I serve a section 21 (4) before the end of May to expire 31st July?

I understand I can proceed through county court's small claims procedure straight away to try to get some of the rent arrears. Is this correct?
