We have a property let on an Assured Shorthold Tenancy Agreement (ASTA) which terminates on 29 January 2011. The tenants are desirous to continue their tenancy and we are happy for them to do so on the same terms. However, they have informally told us that they will probably be moving out at some time in the next few months.

Should we prepare a new one year ASTA to commence on 30th January 2011 or do we allow this to lapse into a statutory periodic tenancy? If th elatter, how shoul dthis be document so that the tenants understand?
