We have tenants in a property on a shorthold tenancy agreement who paid the first months rent then have not paid since. They moved in on 7th July so they are about to become 2 months late and also hit the point where they will have been in the property for 2 months. Several people we know have said that after 2 months it will become more difficult to get them out because they get more rights at this point. Other information we have seen says it becomes easier to evict after 2 months non payment as there are clear grounds for repossession. We have served a section 8 notice already and are planning to serve a section 21 when they become 2 months overdue. The council have agreed to pay us some backdated benefits which we do not believe will meet the amount in arrears. In any case, we want them to leave as they have been so dishonest with us since they moved in and they have breached the tenancy agreement by not keeping the house tidy and by smoking on non smoking premises. What would you suggest? How can we make sure our section 21 is fully valid as we hear there are lots of ways it can be served incorrectly?
