My tenant has just told me that her partner (who pays the rent) has just lost his job and is not likely to have any funds in the immediate future. January's rent is now 3 weeks in arrears and it is not looking any money is forthcoming as they have no savings. She says she is going to try and sort it out but it looks like they will need to move out and find somewhere cheaper - she has left it that she will "get back to me".

Should I just serve them notice now? I don't want to be unkind but I am concerned that the longer this drags on, the more time I will be without income. Can I take them to court for the rent that is due, both last month and the coming month whilst they are living there but living out the notice period?
