I have a group of seven students who's deposit I protected last year with dps

they signed a new agreement to stay another year at the property, the agreement to commence next week (they signed it a few months ago)

they have now changed their minds and want to move out and have signed a contract elsewhere... the landlord says I must keep all the deposit now as the house will be empty and they are in breach of their new contract and I agree with this. If they dispute it (they probably will becasue they are claiming to be forced out by a bad neighbour) then should I have reprotected it? Because it can't be registered under the current agreement and the new one at the same time? I don't want to get caught out by a loophole...
