We served a section 21 notice on a tenant, then the court possession, the tenant appealed stating he had not received the notice, a certificate of service and photos were taken when served.
We received a letter from the court on the 23.6.15 in the post at 12.20 pm stating that we must attend court at 10am on the 23.6.15?.
We immediately contacted the courts call centre who advised us to contact the court and inform them that we had not received the notification to attend court until after the hearing, we did this by email and letter, we received a read confirmation of the email but no reply.
We then received confirmation that the case nbe struck out on the 29.6.15.
We then received a letter from the court on the 10.7.15 stating that the we must now we must request another hearing by formal application and pay the relevant fee.
Please confirm the best way to proceed as the tenant has rent arrears of over 3000.00 and has stated the he has no intention of paying.
