I have an American tenant on a student visa which will expire on 1 November?
She says she is applying for sponsership and jobs to extend but nothing is certain, and otherwise will return to US to apply for new visa ,and she wants to continue the tenancy even if she has to leave the uk to apply.

I am risking committing an offence by not serving notice to expire at the end of her current visa in case she does not get an extension and she stays in the UK after expiration contrary to what say has indicated?
If she does go back to the US, could we terminate the tenancy, but not let out the property ,on payment of an amount monthly equivilent to the rent, pending her return ?
