My tenants are now 2 months in arrears, having told us that they will not be paying rent due to having been served a Section 21(b) notice for them to leave on 3rd July.

I sent them a polite letter last month reminding them of their obligation to pay rent and asking them to rectify the situation but have heard nothing.

I want to write to them now asking them to pay within 2 weeks or if not face being taken to a small claims court. But would like advice on whether or not this is the most appropriate course of action. I also suspect that I will be taking them to court to gain possession of the property as there seems no incentive for them to leave on 3rd July if they are living there rent free.
