I now have a hearing in Small Claims Court since I made the claim in june09. The tenant owes £1020 rent now he counter claims that he left due to mould growth. I noticed this mould near his window after he left, but I suspect they dis not turn on the heating much, during his occupancy they used 395 units of gas in the 10 months, whereas the year before the tenants used 910units of gas. he claims the heating and hot water was not available, but it was working and I have a British Gas three star cover. No one told me that it was not working. I could call British gas out and the repair would not cost anything. The house has electric shower and it works.
Can a tenant successfully do this kind of counter claim? any one with similar experience?
