Served Section 21 notices for Fixed Term Assured Shorthold tenancy
We have a tenant who is under Fixed Term Assured Shorthold Tenancy. We have served notice for possession, which will be on 3rd November, 2012. There are two months rent arrears from the tenant. Can we serve section 8 notice also as breach of covenants? We spoke to the tenant and tenant confirms he cannot pay due to pending repairs in the property, which as a matter of fact was never informed by the tenant to us. It is clear cut case of evading the rent.
Kindly advise how to proceed further in this regard.
