We have a tenancy agreement in joint names but the problem now is that one tenant died on 8th January in hospital and his partner was taken into hospital at the same time and is still in hospital. The solicitors for the tenant who died, who are the executors, wrote to tell us what had happened but also said 'they are not able to terminate the tenancy at present because the flat contains the effects of both the deceased and his partner and assume that his partner will wish to return to the flat when she is well again'. No contact has been made by the surviving partner although we have found out which hospital she is in at present. I have been back in touch with the solicitors but they cannot tell us any more and believe that none of the deceased relative's have been to visit her. We are now three months in arrears with the rent. Can you please tell us our options as we cannot let this unsatisfactory situation go on any longer. Also:
1. As the solicitors have said they cannot return the flat to us are they still obliged to pay rent for the deceased? Both parties have signed the contract so is either fully responsible for all the rent?
2. If we do have to give notice where do we send the notice to as the surviving partner is in hospital?
