On an RLA training event I learnt about Regulation 91 of The Housing Benefit (General) Regulations 1987 which obliges a local authority to make payments of Housing Benefit on account after 14 days of being in receipt of all the information necessary to determine an applicant's claim. I have used this legislation successfully with Luton Borough Council on several occasions. The Authority routinely take 14 weeks to determine claims otherwise. The Authority have now written explaining that this legislation was replaced by The Housing Benefit (General) Regulations 2006.

Is this correct and, if it is, which of the Regulations should I quote in future?
