We have a tenant who's husband has recently lost his job - they are now on housing benefit which is paid two weeks in arrears. The cheques are made payable to the tenant and sent to the tenant direct. They are now five weeks in arrears (two weeks via housing benefit) plus another three weeks due to them spending the housing benefit cheque on speeding and parking fines and not the rent. I have spoken to the tenant who says she will try to make up the shortfall by paing 10 per week (if she can afford to) until the monies have been made up. Their tenancy agreement is due up in May and they signed the Section 21 notice when then signed the original Tenancy Agreement back in November. My questions are: Can we still take possession of the property in May even though we haven't mentioned the Section 21 notice since November? Can we do anything about them spending the housing benefit cheques on other things? Many thanks
