Dear helpdesk...
My tenant owes approx 5 months' rent. Much of this rent has been claimed directly from DSS by tenant on housing benefit and not passed to me- the usual scam. On the plus side, I don't need to evict- he finally vacated the property in December. We agreed verbally (and with written confirmation) that half the money owed should be paid back in installments. He has not started to do this by the agreed date, and now I don't expect him to do so. He is claiming poverty (on benefit with young baby), but has assets e.g.substantial electrical goods purchased in last two years.
If I go to court for CCJ, will the court allow repayment if he is on benefit? Do I need a seperate enforcement order when he doesn't pay (e.g. for seizing assets?)
Finally are there any figures on success rates for this sort of thing? The tenant knows exactly what he is doing- making it as hard as possible for me, and the court, to get back money owed. Should I even be bothering?

HELP!
any advice gratefully received.
