I have given my tenant a section 21 notice on 1.12.10. this will expire on 31.1.11. He will not leave until I have gone through the full eviction process. I have been informed today that the boiler has broken down and that there is no hot water or heating. I will of course try and get this fixed straight away. My question relates to my obligations to fix the boiler once the date 31.1.11 passes. My tenant is in arrears of approximately 3500 and each month he gives me less rent than what is due. If I am unable to get the boiler fixed by 31.1.11 as I suspect I may need a new boiler, can I insist on the tenant paying for the new boiler before I get it installed.
