For the purpose of issuing a section 8 notice for rent arrears can housing benefit, which is paid 4 weeks in arrears, be used in the calculation.
For example I have a tenant who is currently £975 in arrears and who's monthly rent is £550 therefore requiring her to be £1100 in arrears (2 months rent) before I can pursue a section 8. However if I include the yet to be paid benefit as arrears this would put the figure over £1100 now. Is this permissible?
