I used to have an AST for the 5 tenants in my house but 1 by 1 the tenants who were on the AST have left and I didnt issue a new AST with the new tenants names on it. The verbal agreement/assumption was that they were taking over the lease from the departing tenants. I know its not the way I should have managed it but thats where I find myself now.

I am in the situation that I have 5 tenants who are renting my house and none of them have a signed lease. I want to sell the house and require them to move out. I am going to serve them with the Section 21(b) notice tomorrow (1st Nov) and ask them to move out by the 18th February 2010. I'm basing this date on the fact that they pay rent on the 18th of the month and I'm going to give them 3 months (not just 2) so that they have sufficient time to find a new place. 18th Jan would be very close to the xmas/new year period.

Would this be the best way to serve notice ?
What if they give me grief and start claiming that I can't do this. 1 of the 5 tenants is a prize nuisance so its possible that she starts claiming her rights and perhaps say I can't do this. She doesnt have a written contract and although she only moved into the house on 12th Sept 2009 by replacing another tenant she already mentioned that if I was going to ask them to move out I would not be able to do this for 6 months.

In the absence of a signed lease what are the rules ?
