Given Section 8 notice when part of rent has been paid.
I intend to give notice to a tenant to vacate under Section 8. However, while the tenant has been constantly in arrears for over 1 year, they have normally contribute some small amount the the arrears which means they don't reach 1 clear month plus 1 day of arrears.
Can I still give notice under Section 8?
The situation now is that they have paid £400 towards the rent that was due on 15th December 2010. Since their monthly rent is £790 (£26 per day) they have effectively paid until 30th December. Does this mean I can serve 14 days notice on 31st January, to expire on 14th February?
