Hello,

I intend to give notice to a tenant to vacate under Section 8. However, while the tenant has been constantly in arrears for over 1 year, they have normally contribute some small amount the the arrears which means they don't reach 1 clear month plus 1 day of arrears.

Can I still give notice under Section 8?

The situation now is that they have paid 400 towards the rent that was due on 15th December 2010. Since their monthly rent is 790 (26 per day) they have effectively paid until 30th December. Does this mean I can serve 14 days notice on 31st January, to expire on 14th February?
