I have a tenant who has signed an agreement for 12 months [through an agent] he has now defaulted on 3 rent payments. His father is guarantor. I have written letters to both parties without success. I wish to serve a S 21 Notice for him to leave the property [I do not wish to serve the Section 8 as it seems the process is more difficult]

I have used the RLA AST Room Only contract version 08-10. There is no break clause in this agreement.

Can I serve a Section 21[4][b] Notice on the tenant to vacate the room even though his contract ends in September 2013 to leave in 2 months time? He would have been in residence for 7 months when his notice is up.
