Please can you advise on the following situation? We are acting as agents to a landlord, who has a property that was without hot water for a total of 17 days due to a faulty boiler. The landlord believes that no compensation is due because he booked a plumber within a day of the problem, however wasn’t satisfied with the report, so booked another plumber, who then ordered a part which took a number of days to arrive.

The tenants are proposing to withhold rent for 10 of the days of the 17 day period, which they suggest they deduct from their next rent payment.

We would like to know the legal situation, in order to advise both parties. What compensation are the tenants due? Is this worked out as a percentage of the rent? What cases have set any precedent?
