Hi, to cut a long story short I have had to apply to the court to get a possession order to get a tenant out. The tenants original AST has expired and i have applied on this basis.
The original tenancy started on 5th April 2007. The deposit is being held by me. I was advised by yourselves on the forum that the deposit protection scheme only applies to deposits "taken on or after 6th April 2007".
I have this morning recieved this reply from the court:
"Upon referral to the Court file, district judge Vokes has made the following directions:
"The tenancy is one that requires compliance with the Tenancy Deposit Scheme: please adduce such evidence. retention by the landlord alone is not sufficient"
yours etc....
Where do I go from here ??
