Hi everyone

I was hoping for advice

I have a property who I have rented out for over a year with the same people

I have now discovered the original tenants have moved out and are subletting with quite a large mark up

I have spoken to the current tenants and they intend to move in about 2 weeks time out however they have paid a large deposit with the original tenants (they have lied to them saying they were the landlord) about 2200 gbp and naturally want that back.

I hold a deposit with the DPS for the original tenants for about 1400.

The tenancy I hold runs out at the end of December

I think the original tenants are going to do a runner before then.

Can I with hold the 1400 deposit?

It is with the dps?

Should I have this money to the current tenants?
