Tenants moved in in May 2008. Condition of flat was very good. Full inventory done.
August 2008 inspection visit by agent - no issues raised, all in good order.
November 2008 - tenants complained of severe damp in flat, said making asthmatic daughter ill. We confirmed that damp caused by condensation - black mould in 4 rooms etc. Tenants refuse to fix as saying not their fault. Cost to repaint etc is about 1500.
We have owned the flat for 8 years and had various tenants in the flat and never had a problem before (except once in the bathroom the previous tenant reported slight mould growth. Because of this, last year January we replaced the whole bathroom and inserted an extractor fan).
The flat is double glazed, has a new Valliant boiler, an extractor fan in the bathroom and one above the cooker. There are windows in every room.
The tenants have given notice to move but they have no intention of rectifying the problem in any way. They believe that the TDS will refund their deposit in full.
The damage caused to the flat is fairly bad.
What is the likely outcome?
