A situation sometimes arises when tenantís goods are damaged by damp in their rented property. Tenants may find white mould on furniture and want to claim damages. If the poor condition of the property is the cause of the damage, the blame will be on the landlordís shoulders, and the tenant could sue for repair or replacement, whichever is the cheaper. However, the cause of damage might be as a result of the tenant not heating or ventilating the property adequately, in which case the landlord would probably not be liable. If the tenant wishes to sue for damaged property, he must prove that the blame lies with the landlord.
