We have been to County Court in Brighton today and lost the case regarding a tenacy deposit. We unfortunately took a deposit 925 25/5/08 and in error did not place it in a deposit scheme.
Our tenant was in arrears with her rent, so we started an online claim, then she started a counterclaim 29/3/10, which included the tenancy deposit not having been protected. We placed the 925 in TDS 7/4/10 and sent the tenant the required information. We thought that because the deposit was protected before going to court we would not be liable for the fine (3X 925) However the judged ruled in favour of the tenant stating that the money must be protected before a case is actually filed. He imposed the x3 deposit fine. He also told us that we could not appeal against his ruling.
I notice that RLA helped a landlord in case Harvey v Bamforth, is there anyway you would be able to help me? What can we do next, if we can't appeal?
