We have been to County Court in Brighton today and lost the case regarding a tenacy deposit. We unfortunately took a deposit £925 25/5/08 and in error did not place it in a deposit scheme.
Our tenant was in arrears with her rent, so we started an online claim, then she started a counterclaim 29/3/10, which included the tenancy deposit not having been protected. We placed the £925 in TDS 7/4/10 and sent the tenant the required information. We thought that because the deposit was protected before going to court we would not be liable for the fine (3X £925) However the judged ruled in favour of the tenant stating that the money must be protected before a case is actually filed. He imposed the x3 deposit fine. He also told us that we could not appeal against his ruling.
I notice that RLA helped a landlord in case Harvey v Bamforth, is there anyway you would be able to help me? What can we do next, if we can't appeal?
