Can you advise whether the deed of assignment of tenancy is sufficient in the case of a change of tenant DURING an AST in regard to the handling and registration of deposits?

I can see there is also a need for an amendment of the TDS certificate (which is possible under the UNIPOL scheme), but there are also the following issues to consider: -

1. How are deductions in respect of the leaving tenant determined on the communal parts of the building that cannot be inspected while the remaining tenants are still living in the property?

2. Does the leaving tenant have to wait for the return of his deposit until the end of the tenancy (when a full inspection can take place, unless the tenants decide to sign an AST for a further period)? This would be in contravention of the tenancy legislation however, as officially his tenancy has ended.

3. Does the new tenant have to take on liability for deductions from the leaving tenant?

This is obviously a very tricky area - if anyone has any solutions, please let me know!
