After not paying the 2nd month of her tennancy I issued a claim against her in court.A judgement has been issued which she has accepted. Now she is 2 months in arrears so I immediately served a section 8 notice. This runs out on 13th but the 11th the tennant paid 1.25 months of rent so is no longer 2 months in arrears. Do I now have to wait and see if she will become 2 months behind again and serve another section 8 then or should I go ahead and send off the court papers now. (She is in her 3rd month of her 6 month contract.) She has told me she is off work and having an operation on her back later this month and expects to be back at work in 6 months. She has already given me quite a few contradictory excuses for not paying that I am not sure whether I can believe it now. My council told me they would only pay me the housing benefit direct if she was abusing drugs although wouldn't admit to her actually receiving any. Can anyone tell me what my options are and is the money paid the first months rent plus a bit of the second or the second months rent with a bit of the first with the rest payable according to what the courts work out?
