As we are not members of a Tenancy Deposit Scheme, we used the following wording for the additional months rent paid by the tenant upon taking up occupation as well as their month's rent in advance:-

`The Landlord is currently holding one months rent of 1,400 which shall be returned at the end of the tenancy, subject to there being no breaches of the terms of this agreement.`

The tenant is now over two months in arrears (2 months at 1,400 + previous arrears of 723). total 3,523.

We wish to serve a Section 8 Notice and would like to know if this is in order at this stage?
