My tenant has declined/refused to take part in a check out of the property
There are several carpets that have dirt and stains on them and will require professional cleaning.
He made a claim to the DPS for the return of the deposit before he moved out.
He is obviously not going to agree to pay for the cleaning because he has emailed me to say that he does not wish to discuss things further, and there will be no professional cleaning on his part.
Where does this leave me with the DPS? I have photos of the carpets prior to occupancy and after the tenant had departed.
Can my tenancy agreement be used as evidence to defend my position, which is that he would not wait around to take part in the inspection, and so my evaluation is final and binding upon the tenant. This is what is stated in the tenancy agreement. My estate agent was present when the tenant told me that he was going.
