not put into a deposit scheme

Please can you help me,

I have had a tenant for 6 months who is now looking at leaving.

When he moved in he gave me a deposit of 500 and i wrote this on the tenancy agreement i done for him. Unfortunately i did not put it into a deposit scheme as he was unsure that he would stop there. Now he has finished his tenancy agreement he obviously wants the deposit back but when he moved in we had a verbal agreement that he would tidy the flat up and in doing so i wouldn't charge him the first months rent. None of this was put onto the tenancy agreement though.

Am i better off just paying him the deposit and put it down to experience or have i got a leg to stand on seeming i didn't put it into the deposit scheme to start with ?
