Possession procedure -info requested
Bl.... useless agents put in 3 tenants in my property in July. Said they checked references etc, but my follow-up checks on them revealed loads of inconsistencies (with tenancy agreements and their vetting of tenants). My initial suspicions about the tenants have proved to be right, while the agents have around £5,000 in full management fees (for the 24 month tenancy) in their bag.
Net-Net the tenants have been in rent arrears for 3 months now. I have not received a penny since they defaulted on their agreement. Through Landlord action we issued a Section 8, 10, 11 on 31 October. Their time is up and we have received no response.
Last week the council sent me a letter at my home address that neighbours were complaining about rubbish collection outside the rented property -Environmental issue. I reported matter to agents and briefed the council. The agents sent rent arrear letters and the council letter to the tenants. They also have knocked on the door without any reply. They wrote to them that I wanted to visit to undertake immediate action to remedy the environmental issue. More than 24 hours notice was given and I went to the property with a rep from the agents to talk to the tenants and to inspect the premises this lunchtime.
We rang the bell. No reply. So I opened the door and asked if anyone was in (several times). The property was empty. No food in the fridge or clothes in the cupboards. There was extensive damage to the bathroom that I had spent over £6,000 repairing after the last lot of tenants left. I have to now redo part of the bathroom and to repair the water damage to the ceiling donwstairs -yet again. The carpet is destroyed. In any case, the letters sent to them were clogging up the entrance hallway and they had not been opened.
Can anyone tell me what the possession procedure is now? Can I go in and change the locks and take possession?
