Hi,

We have a tenant that is getting into serious arrears although not quite two months yet. I think there is a good case to send a section 8 on some of the discretionary grounds (ie rent has never been paid on time yet), but not the statutory 2 months bit yet.

Is it a good idea to serve a S8 now on discretionary grounds followed by another later. Presumably they remain valid for quite some time. I did think if it gets hot he might leave. The house we are letting is next door to us and he already tries to avoid us, parks in surrounding streets and never opens the curtains so he doesn't feel that comfortable about it.

One other question, does the two months arears start from the date payment is due or since that payment is actually made in advance, is it the end of the month.

One final question, when you go to court, how long does a S8 take to get an order, and is it longer than an S21?
