getting tenants out and retrieving white goods
In Dec 06 I gave a temporary tenancy to a family whose house build was not quite ready and had sold their own house. The flat is one bed and there are two adults and two children boy 11 girl 8.we will call the P. they begged me to help them and also told my agent that it would only be 4-6 weeks at most.In the meantime another person Ms H asked to take the flat tenancy. On 18th January P informed me that only the building inspection was to be done. I contacted ms H and she paid me the deposit. Over the next few weeks different dates were given for moving out and I even spoke to the builders, David Wilson Homes, on 6th Feb and they stated that there was only two days work left to do and the building inspection. Time went on and Ms H said that she would have to look elsewhere if she didnt get a moving date within a week. I then gave P three weeks to move out.
P went to Leciester homelesss advice centre (LHAC) who said notice was illegal. I then gave Notice to Quit stating Ground 17. LHAC said tenanacy agreemt was illegal should have been minimum 6 months. On advice of LHAC I then gave P letter state previuos tenancy null and void and tenancy would end on 9th June 2007. P did not agree to this.and called police to say I was harressing her
Point 2 when P moved in there was a fridge dryer and washing machine which were not part of the unfurnished tenancy agreement. I had intented to put these in the garage for future use. p said that she would use them. Bear in mind I was informed that the machine would only be needed there for 6 weeks. The washing machine needed a hose which I bought and she paid 20 pounds for my friend to fix it in properly. Now one of my furnished flats has come vacant and the washing machine there belongs to the tenant therefore I want the machine from P to put in the other flat. I wrote to P gave her 48 hours notice that I intended to collect the machine. When I arrived I knocked on the door twice and got no answer, I used my key to open the door slightly and called hello which I always do at all times irrespective of anything else. P came to the door refused me entry and called the police again.
Police came and took P's side, totally beleived that I had been harressing her and warned me to keep away from P . P informed them that the LHAC had told her that I could not have the washing back until she had left. She also told police that she had paid up to 9th April, not true, and she would leave then, seems she has not recognised 6 month tenacy agreement and will only do what she wants.
I realise that I have got in a mess of my own doing and with hindsight be landlord first and human being last. But don't know what to do next.
