Tenant in prison
His AST is now periodic tenancy.
His rent is paid by housing benefit with the tenant making up the difference in the housing benefit payments.
The tenant has been consistently late paying his rent since september 2006.
I have been informed today that the tenant has been sent to prison for five months for driving offences, although the tenant seems to think he will be out in 10 weeks?
Can you please answer the following...
1. Can we evict a tenant who is in prison?
2. If we can what is the best way to do this, is it via a S21 or S8 notice?
3. How do we serve notice on the tenant, do we have to send it to him in prison?
Any advice would be appreicated
