I have a tenant with arrears of 3 months and I have served a Section 21a with the Shorthold tenants agreement. I served a Section 21b notice on the 21st May 2007, the section 21b runs out on the 1st August 2007.
The Assured Shorthold Tenancy Agreement has run out on 2nd of June 2007. Because the tenant was in arrears no new agreement was made. If I am right the tenant now has a statutory agreement.
I have now received a form to get housing benefit paid direct to the Landlord from the benefit office, but apparently no benefit has been agreed. The benefit office also want to know what rent was paid pre 2nd June 2007 and what rent has been paid post 2nd of June 2007 also the amount of arrears to date. In any event their office pay the benefit they decide upon in arrears.
They also want to know what the new rent from 2nd of June 2007 will be. The rent due was 690.00 per calendar month until that date 2nd June, although it was not being paid. So what should I set it at or should it remain the same for some technical legal reason? I am puzzled, help!!! I may still have to sue for eviction. Yesterday I sent a statement requesting all monies owing plus interest as per the agreement giving 7 days to pay before legal action is taken.
Hopefully with help this may get resolved but on 2nd August 2007 if it is not then I will be forced to go for eviction. Sorry this is so wordy buts lots of landlords have been in this position and they could help us all in it now.
