We let a studio flat to a polish couple. Unfortunately we have received a letter from the freeholders of the property as detailed below.

The AST was a RLA one signed on the 1st June for 6 months and section 21 b was also issued at that time. So the earliest they can go is the 1st Dec. Unless we take further action.

7 days ago we have written offering them the months rent back if they leave by this saturday, but have not heard anything from them. The letter was in English and translated into Polish.

If they do not leave.......

I understand the grounds on wich to remove them and only 1 may be suitable to get them out before the end of the AST. This being ground 17 where they GAVE A FALSE STATEMENT to take out the tenancy and intended always to allow more than two people to live there. the other grounds are only manditory and the noise and nusance could take longer that the 1st Dec to get through and could be defended.

can this type of thing affect their working visa's

Are my thoughts correct and does anybody have any helpful advice?

Letter from freeholders........
"we have received numerous complaints regarding your tenants and their visitors activities, ie loud noise, shouting and running up and down the communal stairs late at night also the police have been called on at lease one occasion and the local authority has a complaint lodged against the property. This behaviour is causing a nuisance to the other property owners and as such places you in breach of your lease.

Under the covenants of the lease Schedule 3 part 1 "do not use the premises nor permit the same to be used for purpose other than a private dwelling house in the occupation of one family only" and we believe this is not the case.

We must also complain that mattresses old TV and furniture adn being placed on the landing and winin the bin room. Refuse collectors do not collect these sort of items.

In Addition to the above, under the provisions of your lease, if the disturbances continue your lease of the above property will be determined and therefore any interest you have int he property will cease.......................
