Whilst I issue an section 21 on the first day of tenancy as per RLA recommendations it does appear that this does confuse the courts when requiring accelerated possession.
I have to visit my local court next week as the judge is questioning the validity of the notice, issued Sept 2005. I feel that it is the opinion that a more recent s21 should have been issued??
I really am now thinking that it is easier (if not too worried re the time) to issue a section 21 when the problem arises which is going to result in possession.
There is also a question to answer on the day re the exact claimant?
The RLA tenancy agreement shows the landlords name Mrs Speight - followed by the name of the letting agent (Also on section 21). I have contacted you previously to confirm that this is correct so i do not know what if any the problem may be? Any thoughts would be appreciated
