Gardens - who's responsible?

Hi,

We are a management agency and we are currently fighting a battle with a very old school landlord.

Our tenancy agreement states that if the landlord provides tools for the garden then it is the tenants responsibility to keep it maintained. If there are no tools provided then it is the agency that should organise the garden maintenance at the expense of the landlord.

This particular landlord has a 6 bedroom student property with a large garden and has not provided tools. He is also saying that the tenants still need to maintain the garden at their own expense even though our tenancy agreement says otherwise.

Is there any legal obligation for the landlord to maintain the garden if he has not provided tools?
