I have some tenants who are in receipt of Housing benefit. Throughout their term they have always had several minor complaints but just recently they called in the Housing Health and Safety department who identified a few faults.

My question is that under the NLA assured Shorthold Tenancy Agreement that we hold with the tenants, would a broken pane of glass ine front door be the landlord's responsilbity or the tenants. We have actually replaced this as they said some one had tried to break in but we are fairly sure that their children broke it. Also the children broke some glass panes on the greenhouse, are we responsible for replacing the glass or them. As I understand it these two items would appear to be fixtures and fittings in the property. They have also piled up rubbish all round the greenhouse which I do not think we should be responsible for clearing, it is their rubbish not ours. The other points were minor in the house which we are prepared to repair but I wanted to know my rights as a landlord before I respond to the Council dept.
