Sometimes, but not very often, after a landlord has served a Section 21 Notice on a tenant, giving the tenant two months notice of repossession, the tenant will issue their own notice giving the landlord just one month’s notice, ending before the end of the Section 21 Notice, the tenant having found alternative accommodation, for example. Remember that the tenant is not entitles to leave before the end of the fixed term, and if he does leave early, you are entitles to rent to the end of the fixed term: service of a Section 21 Notice does not entitle the tenant to leave before the end of the fixed term. If, however, the tenancy has become periodic, the tenant can give one month’s notice to leave, regardless of the fact that you have served a Section 21 Notice to end at a later date.
